By accessing or using the Apex Ideology website or platform (the "Services"), you agree to be bound by these Terms of Use. If you are using the Services on behalf of an organization, you represent that you have authority to bind that organization to these terms. If you do not agree, do not use the Services.
The Services are intended for business use by individuals age 18 or older. You are responsible for the accuracy of the information you provide, for keeping your credentials secure, and for all activity that occurs under your account. Notify us immediately if you suspect unauthorized use.
You agree not to misuse the Services. That includes: attempting to access data you are not authorized to see, interfering with the operation of the platform, reverse engineering the software, uploading malicious code, scraping the Services, or using the Services to violate any law or the rights of others.
You retain all rights to the operational data you connect to or upload into the platform ("Customer Data"). You grant us a limited license to host, process, and display Customer Data solely to provide and improve the Services. Our handling of personal information is described in our Privacy Policy.
The Services, including all software, dashboards, visualizations, brand assets, and documentation, are owned by Apex Ideology Inc and protected by intellectual property laws. Except for the limited right to use the Services under these terms, no license or ownership right is transferred to you.
The Services may connect to or interoperate with third-party systems that you authorize. We are not responsible for the availability, accuracy, or terms of any third-party service, and your use of those services is governed by their own agreements.
If your access to the Services is provided under a paid plan or written agreement, the applicable fees, billing terms, and renewal conditions are set forth in that agreement or order form. Fees are non-refundable except where required by law.
The Services are provided "as is" and "as available" without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, error-free, or that any defects will be corrected.
To the maximum extent permitted by law, Apex Ideology Inc and its affiliates, officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, arising out of your use of the Services. Our aggregate liability for any claim arising out of these terms will not exceed the amounts paid by you to us in the twelve months preceding the claim.
You agree to defend and indemnify Apex Ideology Inc from any claims, damages, or costs arising out of your use of the Services, your Customer Data, or your violation of these terms or applicable law.
We may suspend or terminate your access to the Services if you breach these terms, if required by law, or if we discontinue the Services. You may stop using the Services at any time. Sections that by their nature should survive termination will do so, including intellectual property, disclaimers, limitation of liability, and governing law.
These terms are governed by the laws of the State of California, without regard to conflict-of-law principles. The exclusive venue for any dispute arising out of or relating to these terms is the state and federal courts located in Sacramento County, California, and you consent to personal jurisdiction there.
We may update these Terms of Use from time to time. When we do, we will revise the "Last updated" date at the top of this page. Continued use of the Services after changes take effect constitutes your acceptance of the revised terms.
